About these terms

These terms apply to anyone who uses giftex at giftex.app — organizers who create exchanges, participants who receive a link, and people who join the beta waitlist. giftex is run by Peter Londry, an individual based in Ottawa, Ontario ("we", "us"). By using giftex, you agree to these terms and to our privacy policy.

The beta

giftex is currently in beta and available by invitation. Features may change, be removed or not work as expected, and we may reset or delete test data with notice. We'd love your feedback — it helps make giftex better.

Your account

• You must be an adult to create an account and organize exchanges.
• Keep your password safe. You're responsible for what happens in your account.
• Give us an accurate email address so we can reach you.

Adding people

When you add someone to an exchange, you confirm that they've agreed to take part and that you're allowed to share their name and email address with giftex for that purpose. Participants can ask us to remove their information at any time.

Acceptable use

Please don't use giftex to:

• Send unwanted email or add people who haven't agreed to join.
• Harass anyone or send hateful, threatening or illegal content in your messages.
• Try to reveal other people's matches, guess private links or get around how giftex works.
• Interfere with the service, overload it, or access it in ways we don't offer.

We may suspend accounts that break these rules.

Fees

During the beta, giftex is free to use. When fees apply, the price will be shown clearly before you pay, and payments are processed securely by Stripe. Fees are the only way giftex makes money.

No automatic renewals. Nothing you buy from giftex renews or charges you again on its own. You pay only when you choose to.

Yearly pass. The yearly pass gives you Plus features for up to 10 exchanges during the 12 months after purchase, with up to 3 running at the same time. Each exchange can include up to 50 people; larger groups need the Office plan. The pass is for groups you organize yourself — please don't share your account or use the pass to run exchanges for others in return for payment. We'll email you before your pass ends; it then simply expires unless you choose to buy another. If an account goes well beyond these limits, we'll reach out to talk about it before taking any action.

Refunds

We want you to feel good about paying for giftex. If something isn't right, we'll make it right.

• Before names are drawn: full refund, no questions asked. The exchange simply goes back to the Free plan.
• After names are drawn: full refund within 14 days if giftex didn't work as promised — for example, emails couldn't be delivered or a paid feature didn't work and we couldn't fix it. The exchange keeps running so your group isn't disrupted.
• Yearly pass: full refund within 14 days of purchase if you haven't drawn names in any exchange with it yet. After that, no refunds for the remaining time.

To ask for a refund, email admin@giftex.ca from your account's email address. Refunds go back to your original payment method through Stripe and usually appear within 5–10 business days. This policy doesn't limit any rights you have under consumer protection law.

The gifts themselves

giftex draws names and sends links. We're not involved in buying, swapping or delivering gifts, and we aren't responsible for what's given, spent or received, or for disagreements within a group.

Availability & liability

We work hard to keep giftex running and your information safe, but the service is provided "as is", without guarantees that it will always be available or error-free. Emails can occasionally be delayed or filtered as spam by your email provider. To the extent the law allows, we're not liable for indirect losses, and our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits rights you have under consumer law.

Ending your use

You can stop using giftex and delete your account at any time from the Account page. When your account is deleted, all information associated with it — including every exchange you created and its participants' details — is permanently removed from our platform, and any reveal links you sent will stop working. We may suspend or close accounts that break these terms, and if we ever shut giftex down, we'll give organizers reasonable notice so they can finish their exchanges.

Changes, law & contact

We may update these terms as giftex grows. We'll change the date above and email organizers before significant changes take effect. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. giftex is based in Ottawa, Ontario.
